Your (“user” or “you”) use of and access to the website, services, products and other related online and offline offerings and services (including our social media pages) (collectively, the “Services”) from Exponential Exposure is conditioned upon your compliance with and acceptance of these Terms and Conditions and all incorporated policies (including our Privacy Policy) (the “Agreement” or “Terms”).
If you access, purchase or enroll in Services for use by another (for example, a parent purchasing for a child) these Terms govern both you and other(s) who use any Service you purchase (collectively, “you” or “user”). You agree to be bound by these Terms, which will be considered a binding, legal agreement between you and the Company. Please read the Terms and Conditions carefully before you start to use the Services. If you do not agree to these terms, please discontinue your access to and use of the Services immediately.

Our Role
We offer academic and career planning information, products and services. We assume no responsibility for any result or consequence related directly or indirectly to any action or inaction that users take based on the Services or any other information available through or in connection with the Services.

Eligibility

Exponential Exposure controls and operates the Services from offices in the United States of America. We make no claims that the Services or any of its content is accessible or appropriate outside of the United States. If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
By using the Services, you represent and warrant that you meet the eligibility requirements; and you agree to abide by these restrictions, and agree not to help anyone avoid these restrictions. If you do not meet all of these requirements, you must not access or use the Services.
User’s Access & Scope of Use
- You may access and view the Services only for your personal, noncommercial use.
- When you download copyrighted material you do not obtain any ownership rights in that material.

We cannot be responsible for maintaining Your Content that you provide to us, and we may delete or destroy Your Content at any time.
Information About You and Your Visits to the Website
All information we collect on this website is subject to our Privacy Policy. By using the Service, you consent to all actions taken by us with respect to your information in compliance with our Privacy Policy and applicable data protection laws.
Orders
- An order is not binding upon Company until it is accepted. Company must receive payment before it will accept an order. Your order will be deemed accepted by Company when Company processes payment for your order or you receive an order acceptance notice (by email), whichever is sooner. You must complete payment prior to commencing the Services unless you participate in installment or subscription billing, as applicable. If available and you select installment billing we will charge an installment billing registration fee and make the specified charges to your credit card as reflected in your order summary or invoice. Failure to complete timely payment (or credit card payments being declined) may result in the discontinuation of services. You authorize all such charges.
- Products or services advertised on the website may not be available when ordered or thereafter. If you order a product or service that is not available, we will notify you by email. We reserve the right in our sole discretion to refuse to accept or cancel and refund any order you submit and to limit quantities available for sale or sold to you.
- All prices and other amounts are quoted in US dollars, unless expressly indicated otherwise. We reserve the right to change prices advertised at any time. The total price of your order will include the price of the ordered products or services plus all applicable delivery charges, handling charges and potentially taxes. The price and applicable taxes and charges will appear on the completed order form, and will be charged to your specified payment service when your order is accepted by us or as otherwise set out in your order.
- Purchases may be subject to taxes in many states. Tax rates are different from state to state. You are responsible for paying all such taxes.
- Our payment services are offered by a third-party, your use of such services is subject to those additional terms and conditions, which are incorporated into this Agreement by this reference.
- You are responsible for meeting and maintaining the minimum technical requirements for your selected purchase in order to access certain features of your purchase. Access to products or services may require internet access, for which we are not responsible.
- You acknowledge that assessments are administered by computer and require basic computer skills, and you will not be entitled to retake an assessment or receive a refund of fees if you lack, or lack access to, the computer skills required to take an assessment or if your lack of, or lack of access to, the required computer skills adversely affects your performance on the assessment.
- Subject to the provisions of these Terms and your payment of all applicable fees, we hereby grant you a non-exclusive, personal, non-sublicensable, non-transferable, restricted and limited license to access and use each product or service made available to you. You may use the materials solely for your personal participation in a course and not for any other purpose whatsoever. Unauthorized use of materials is strictly prohibited.
- We will at all times solely own and retain all rights, title and interest (including all intellectual property rights) throughout the world in, to and associated with services and products; and neither you nor any other person will acquire any right, title or interest in, to or associated with any product or service.
Changes, Cancellations and Refunds
Your registration for a service is specific to the particular service for which you have registered. You may not change or cancel an order for a service, unless you have entered into a separate agreement with the Company where that separate agreement details the change, cancellation and refund policy.
In no event may a refund exceed the amount that Exponential Exposure received for the service. Refunds are available only for services purchased directly from Exponential Exposure and are not available for purchases made from other third parties.
Intellectual Property
Our Services contain copyrighted material, inventions, know-how, potentially patentable business method material, design logos, phrases, names, logos, text, graphics, images, photographs, digital downloads, audio clips, video clips, animation, look-and-feel, layout, organization, presentation, user interface, navigation, trade dress, stylistic convention, data compilations and software (collectively, “Intellectual Property Content”). Our Intellectual Property Content is our sole property, and we retain all related intellectual property rights, including, but not limited to, all trademark rights, patent rights and moral rights, interests and title thereto. The compilation of all content on this website is the exclusive property of the Company and protected by U.S. and international copyright laws. All trademarks, logos, service marks and trade names (collectively, the “Trademarks”) displayed on the Services are registered or unregistered Trademarks of Exponential Exposure and/or others, and may not be used unless authorized by the Trademark owner. All Trademarks not owned by us that appear on the Services, if any, are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us. Nothing contained on the Services should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Services.
Your use of the Services does not give you ownership of any Intellectual Property Content.
Confidentiality
You acknowledge that the products and services sold by Company are the confidential and proprietary information and property of Company. You hereby agree to protect such products and services as confidential. As a further condition to the purchase and/or receipt of such products and/or services of the Company by you, whether at a price or for free, you agree you will not, nor allow others, to directly or indirectly copy, distribute, resell, lend, lease, display, teach to others or show these products and/or services to others.
In the event you disagree with these terms, you must immediately discontinue using the products purchased from Company. Anyone viewing or otherwise utilizing the products of Company by such conduct is agreeing to be bound by the terms set forth herein, and as such must immediately comply with the terms of this agreement. In the event that Company discloses any portion of its information to the public, it should be understood that anything not publicly disclosed by Company remains information that you have an obligation to protect and maintain as confidential.
Claims of Infringement of Copyright or other Intellectual Property
We respect the intellectual property rights of others, and require that the people who use our Services do the same. If you believe your copyright has been infringed, or your intellectual property rights otherwise violated, please provide us with each of the following:

EXPONENTIAL EXPOSURE DOES NOT WARRANT THAT THE SERVICES, CONTENT, FUNCTIONS OR MATERIALS CONTAINED THEREIN WILL BE TIMELY, SECURE, UNINTERRUPTED, OR OPERATED FREE OF DELAYS IN TRANSMISSION, FAILURE IN PERFORMANCE, COMPUTER VIRUSES, INACCURACIES, ERRORS, OR DEFECTS. YOU USE THE SERVICES AT YOUR OWN RISK. IN ALL CIRCUMSTANCES OUR MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS OR SERVICES SOLD. COMPANY SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS OR SERVICES IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. Indemnification
You agree to indemnify and hold Exponential Exposure and any affiliates, agents, team members or other party associated with Exponential Exposure harmless from any causes of action, injury, illness, misunderstanding, damages, losses, costs, expenses incurred as a result of your use of the Services, as well as any third-party claims of any kind (including legal fees) arising from his/her actions as a direct or indirect result of your participation in the Services. Should we be required to defend ourselves in any action directly or indirectly involving you, or an action where we decide your participation or assistance would benefit our defense, you agree to participate and provide any evidence, documents, testimony, or other information deemed useful by us, free of charge.
Miscellaneous
- This Agreement shall be deemed to include all other notices, policies, disclaimers, and other terms contained in the Services, including our Privacy Policy provided, however, that in the event of a conflict between such other terms and the terms of this Agreement, the terms of this Agreement shall prevail.
- You agree that Exponential Exposure may assign any of its rights and/or transfer, sub-contract or delegate any of its obligations under this Agreement. This Agreement is personal to you and you may not transfer or assign it to a third party.
- Our failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
- If any part of this Agreement is determined to be invalid or unenforceable under applicable law including but not limited to the warranty disclaimers and liability limitations stated above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Agreement shall continue in effect.
- This Agreement supersedes all prior or contemporaneous proposals, oral, understandings, representations, conditions, warranties, and all other communications between the Company and you. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
- Any dispute arising out of or related to this Agreement shall be governed by the laws of the State of Texas, without giving effect to any choice or conflict of law provision or rule whether of the State of Texas or any other jurisdiction. Company and you consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of Texas, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, you also agree not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Company that is more than one year after the date of the applicable invoice.
- Any rights not expressly granted in this Agreement are reserved to Exponential Exposure.
